Terms of Service (User Agreement)

These Terms govern your access to and use of the Oohla app and related services provided by Oohla Team.

1) Who We Are / Contact

Oohla is provided by Oohla Team ("we," "us," or "our").

2) Eligibility (17+)

The Services are intended for users aged 17 and older. By using the Services, you represent that you are at least 17 and have the legal capacity to enter into these Terms.

3) Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date. Continued use of the Services after changes take effect means you accept the updated Terms to the extent permitted by law.

4) Account Registration and Security

  • Accurate information: Provide accurate information (such as username and email) and keep it up to date.
  • Account security: You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • Unauthorized use: Notify us promptly if you suspect unauthorized access.

5) The Services

Oohla helps you track breakfast moments and mindful morning reflections. The Services may allow you to:

  • Add breakfast entries (including photos and notes);
  • Optionally record voice input (if available);
  • View and organize an archive of your entries; and
  • Use streak and habit-tracking features.

6) License and Acceptable Use

6.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

6.2 Restrictions

You agree not to (and not to assist others to):

  • Copy, modify, distribute, sell, lease, or sublicense the Services;
  • Reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
  • Interfere with or disrupt the Services or bypass security/access controls;
  • Use the Services for unlawful, harmful, or abusive activities; or
  • Upload or share content that is illegal, infringes others’ rights, or violates applicable laws.

7) User Content

You may provide content such as photos, notes, and support messages ("User Content"). You retain ownership of your User Content.

7.1 Permission to Operate the Services

To provide the Services, you grant Oohla Team a limited license to host, store, reproduce, process, and display your User Content only as necessary to operate the Services and as directed by your settings and actions.

7.2 No Face Recognition / No Biometric Identification

The Services do not perform face recognition or biometric identification.

7.3 One-Time Processing / Generation (If You Choose to Use It)

  • Your uploaded photos/text are processed on Oohla Team servers.
  • Your uploaded photos/text are not shared with any third party for that processing.
  • The uploaded photos/text are deleted promptly after processing.
  • The uploaded photos/text are not used for model training or marketing.

7.4 Your Responsibility

You are responsible for your User Content and for ensuring you have all necessary rights to provide it. We may remove or restrict content if we reasonably believe it violates these Terms or applicable law.

8) Privacy

Our Privacy Policy explains how we collect and use information. By using the Services, you acknowledge that we may process information as described in our Privacy Policy.

9) Third-Party Platforms and the Apple App Store

If you downloaded the Services from the Apple App Store:

  • Apple is not a party to these Terms and is not responsible for the Services.
  • To the extent permitted by law, Apple has no warranty obligation with respect to the Services.
  • Apple is a third-party beneficiary of these Terms and may enforce these Terms against you as a third-party beneficiary.

You may also be subject to Apple’s terms and policies.

10) Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Oohla is for tracking and reflection purposes only and is not medical, nutritional, or professional advice.

11) Limitation of Liability

To the fullest extent permitted by law, Oohla Team will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Services.

To the fullest extent permitted by law, Oohla Team’s total liability for any claim will not exceed the amount you paid to Oohla Team for the Services in the 12 months before the event (or, if you paid nothing, USD $10).

Some jurisdictions do not allow certain limitations; in such cases, these limitations apply to the maximum extent permitted.

12) Indemnification

You agree to indemnify and hold harmless Oohla Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms, applicable law, or third-party rights.

13) Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if necessary to comply with law or protect the Services.

Upon termination, your license ends. Provisions that should survive will survive (including disclaimers, limitation of liability, indemnity, and dispute resolution).

14) Governing Law and Dispute Resolution (Binding Arbitration)

These Terms are governed by the laws of the jurisdiction where Oohla Team is principally established, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis, and not in court, except that you may assert claims in small claims court if your claims qualify.

You and Oohla Team waive the right to a jury trial and to participate in class actions, class arbitrations, or representative proceedings to the extent permitted by law.

If binding arbitration is prohibited by applicable law in your jurisdiction, then the arbitration requirement will not apply to you to the extent of that prohibition.

15) Miscellaneous

  • Entire agreement: These Terms are the entire agreement regarding the Services.
  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
